DEP is proposing revisions to Chapter 62-330, F.A.C., including Applicant’s Handbook Volume I and Applicant’s Handbook Volume II for the Northwest Florida Water Management District, published on Feb. 24, 2023. Florida’s Clean Waterways Act of 2020 (Chapter 2020-150, Laws of Florida, codified as section 373.4131(6), F.S.) required DEP to adopt rules to update the stormwater design and operation regulations and the Environmental Resource Permit Applicant’s Handbook using the most recent scientific information available. The proposed rule revisions include amendments to update design requirements and minimum stormwater treatment performance standards that increase the removal of nutrients from stormwater discharges, and additional revisions to strengthen stormwater operation, maintenance, inspection and reporting regulations in accordance with section 373.4131, F.S. The purpose of this public hearing is to present the proposed amendments to the public and provide an opportunity for affected persons to discuss the amendments. The hearing will not adjudicate rights and will not be adversarial in nature.

As noted in the Notice of Proposed Rule, any comments on these proposed rule amendments must be submitted to DEP by March 17, 2023, or submitted to the Department between the date of publication of the notice and the end of the public hearing shall be considered by the Department and made a part of the record of the rulemaking proceeding. Evidence and materials received after the end of the public hearing will not be incorporated into the record. Parties who wish to submit pertinent evidence or materials prior to or during the hearing on March 22, 2023, may do so as follows: by email to Stormwater2020@FloridaDEP.gov, or in person at the public hearing.
